This Privacy Policy outlines the information we collect, how we use and share that information, and your rights and choices with regard to personal information we collect.

INFORMATION WE COLLECT

We collect information from you and about you, in order to provide you with the products and services you request, and to more effectively market our products.  The information we collect includes “Personal Information” as that term is defined under applicable laws.  Personal Information includes information that identifies you as a specific, identified individual, such as your name and address.  We will also treat additional information, including IP addresses and cookie identifiers as “personal information” where required by applicable law. For example, we may collect:

  • Contact information such as your name, postal or shipping address, telephone number, or e-mail address;
  • Your billing address and payment method;
  • Communication preferences for when and how you receive communications from American Frame, including marketing and promotional messages and catalogs;

HOW WE COLLECT INFORMATION

We generally collect information in three ways: 1) information you provide to us, 2) information we collect automatically, and 3) information we receive from third parties, as described further below.

INFORMATION YOU PROVIDE

You may provide your personal information directly to American Frame when you:

  • Request products and services through the Platforms or any shopping channel (online through the sites or by phone);
  • Register for an account, or sign up for catalogs and email alerts;
  • Respond to surveys, participate in focus groups, submit reviews, enter contests or drawings, or register for and participate in loyalty programs; or
  • Contact customer service or other American Frame points of contact to submit questions or requests.

INFORMATION COLLECTED AUTOMATICALLY

We may automatically collect and receive your personal information when you visit the Sites, purchase our products, or otherwise interact with us. We use this information to improve the Sites and the products we offer. If a combination of information we collect does identify you as an individual, we will treat the combined information as personal information. The following are examples of how we automatically collect information through the Sites:

Cookies. Like many online retailers, the Sites use 'cookies', small data files stored on your computer's web browser, or other passive means of data collection. Cookies are used to personalize your visit, remember your preferences, help place your order or to enhance your shopping experience and online browsing. Pixel Tags. We use 'pixel tags' (small graphic images also called web beacons or clear gifs) or similar technologies to track information in the aggregate about your use of the Sites like the web pages you view, the links you click, and the time you spend on a page. We use this information to monitor the effectiveness of our advertising and marketing campaigns so we can learn how to best deliver your customer experience. We also use pixels to track our email campaigns to determine whether recipients opened the email and what links they clicked on from the email.

Embedded Scripts:  An embedded script is programming code that is designed to collect information about your interactions with the Sites, such as the links you click on. The code is temporarily downloaded onto your device from our server or a third-party service provider, is active only while you are connected to a Site and is deactivated or deleted thereafter. 

Analytics tools and aggregate data. The Sites use analytics tools such as Google Analytics, web analytics services provided by Google, Inc.. Google Analytics use cookies to help the Sites analyze how you use the Sites. The information generated by the cookie about your use of the Sites (including your IP address) will be transmitted to and stored by Google, respectively, in aggregate form. Google may use this aggregated information in order to evaluate use of the sites, compile reports on Sites activity and other services relating to Sites activity and usage. Our Sites also utilize HubSpot as our Customer Relationship Management (CRM) platform and for analytics purposes. HubSpot enables us to manage customer interactions, store customer information securely, and analyze visitor behavior to optimize our services. Data captured through HubSpot may include contact information, demographic details, and engagement metrics. This information assists us in tailoring our communications and offerings to better meet your needs. We are committed to protecting your personal data and ensuring that it is processed in accordance with applicable privacy laws and our own stringent data protection policies. Your information will only be used to enhance your user experience and will not be shared with any third parties without your explicit consent.

Chat Technology. Our Sites use an automated customer service chat feature powered by Hubspot to respond to customer inquiries. These chat features collect personal information, including but not limited to email address and the content of chat communications, on our behalf. The Hubspot chat feature uses “chatbot” technology, which provides automated answers to frequently asked questions. Conversations with both our automated and live chat features are recorded.  Recorded chat sessions are used by us internally and are not sold, shared, or used for purposes of targeted advertising. 

INFORMATION COLLECTED FROM THIRD PARTIES

We may also collect your personal information from third parties, including:

  • Third-Party Platforms. If you connect or interact with us on third-party sites or applications such as social media platforms, the third-party platform may send us your information such as your profile information from that platform. The information collected and disclosed to us is controlled by the third-party platform and its terms and privacy policy or as you direct by adjusting your privacy settings on the third-party platform.
  • Other Sources. To the extent permitted by applicable law, we may also receive additional information about you from third-party service providers and/or partners, such as demographic and aggregated transactional information, and combine it with information we have about you to better customize our offerings to you.

 

HOW WE USE INFORMATION

We may use your personal information to accomplish our business purposes including to:

HOW WE SHARE INFORMATION

Except as described in this Privacy Policy, American Frame does not share your personal information outside of our corporate family of companies without your consent. When appropriate, American Frame may share personal information with:

  • American Frame Corporate Family of Companies. We may share your information with our family of companies, including American Frame’s parent company, subsidiaries, and affiliates for business operations and to send you information about products or services we think may be of interest to you.
  • Service Providers.We engage with select service providers who provide services to support our operations such as: order processing and fulfillment, market research, advertising and promotion of products, managing promotions and contests, websites analytics, and other support services. Such parties may, from time to time, have access to your information to enable them to provide the services. Service Providers are prohibited from selling or sharing your information, or for using your information for purposes beyond the scope of the services they are providing on our behalf.
  • Third-Party Marketing Services. We may share the following types of personal information with third parties, including marketing cooperatives and service providers for marketing purposes: name, information associated with your browser or device, approximate location data, customer ID, postal address, email address, phone number, customer loyalty information, transaction related information (such as payment type, date, item purchased, and method of purchase), commercial preferences, and preferences related to marketing communications. One such purpose may include sharing your name, city, zip code, and commercial preferences with third parties for the third parties to send you offers or marketing materials such as catalogs through the mail. In addition, please note that we partner with third parties that collect information across various channels, including offline and online, for purposes of delivering more relevant advertising to you or your business. Our partners use this information to recognize you across different channels and platforms, including but not limited to, computers, mobile devices, over time for advertising, analytics, attribution, and reporting purposes.
  • Other Third Parties. As further described in the “HOW WE USE INFORMATION” section above, we may share your information to protect your safety or the safety of others when we have reason to believe that disclosing the information is necessary to identify, contact or bring legal action against someone who may be causing injury to you, our employees or otherwise injuring or interfering with American Frame rights, property or operations, other customers, or anyone else who could be harmed by such activities; to comply with legal obligations, such as when required by law, or in response to any demand by law enforcement authorities in connection with a criminal investigation, or civil or administrative authorities in connection with a pending civil case or administrative investigation; and to maintain the security of the Sites and services and to resolve or troubleshoot technical issues.
  • When you agree to receive information from third parties or request that we share your information.  We will disclose your information to a third party (or parties) when you direct us to do so or you consent to the sharing, and your information will then be subject to the privacy policy and practices of that third party. For example, you may be presented with an opportunity to receive information or marketing offers from one or more third parties or to use an interactive feature or third-party application. 
  • Successor Entities. We reserve the right to sell, rent, disclose or transfer your personal information to a successor entity in the event of a corporate merger, consolidation, sale of assets or other corporate changes respecting American Frame or our affiliated companies.

American Frame uses cookies, pixel tags, web beacons or similar technologies to provide the functionality of our websites, as well as to help better understand the ways our websites is used, and to serve personalized advertising messages and measure the effectiveness of our marketing efforts.

MARKETING AND INTEREST-BASED ADVERTISING

Like many retailers, American Frame contracts with third-party vendors to serve or send advertisements on our behalf. We partner with these advertising vendors that collect information across various channels, including offline and online, for purposes of delivering more relevant advertising to you. Our advertising partners may place or recognize a cookie on your computer, device, or directly in our emails/communications, and we may share personal information with them if you have submitted such information to us, such as your name, postal address, email address, or device ID. Our partners may link the information we share with them to the cookie stored on your browser or device and collect information such as your IP address, browser or operating system type and version, and demographic or shopping information. Our partners use this information to recognize you across different channels and platforms over time to assist us with our operations including for advertising, analytics, attribution, and reporting purposes.

    California residents may use an authorized agent to submit a request to delete, a request to know, a request to access, a right to request to correct, or a request to opt-out of the sale or sharing of their personal information. To use an authorized agent, a California resident must provide the agent with signed permission to submit the request. An authorized agent should submit requests to privacy@americanframe.com and should include proof of signed permission from the California resident to submit the request. An authorized agent may also call our toll-free number, 800-537-0944, to submit a request. American Frame may deny a request from an agent that does not submit signed permission demonstrating that it has been authorized by the California resident to submit the request. For requests to delete, requests to know, requests to access, and requests to correct, California residents may also be required to verify their own identity to American Frame and directly confirm that they have provided the authorized agent permission to submit the request; however, this requirement and the requirement that an authorized agent submit proof of signed permission will not apply if the California resident has provided the authorized agent with power of attorney pursuant to Cal. Prob. Code Sections 4121 to 4130. In addition, the requirement for an authorized agent to obtain and provide written permission from the California resident does not apply to requests made by an opt-out preference signal.
